Terms of Use
These Terms of Use ("Terms") govern your access to and use of BlueDuck Browser: Secure VPN (the "App") provided by VSEEK LIMITED ("VSEEK," "we," "us," or "our"). By using the App, you agree to these Terms.
1. Eligibility
You must be old enough to use the App under the laws of your country or region. If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. License
Subject to your compliance with these Terms, VSEEK grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, lawful purposes.
3. Acceptable Use
You agree not to misuse the App. You may not use the App to violate laws, infringe rights, distribute malware, abuse networks, attempt unauthorized access, interfere with service operations, or engage in fraudulent, harmful, or abusive activity.
4. VPN and Network Services
The App includes VPN/proxy tunnel functionality using iOS Network Extension Packet Tunnel technology. Users may select VPN locations and route network traffic through available VPN/proxy servers.
VPN availability, speed, location options, and performance may vary based on network conditions, device settings, service capacity, server availability, and third-party infrastructure. We do not guarantee uninterrupted, error-free, or anonymous access in all circumstances.
You are responsible for using the VPN and browser features lawfully. You may not use the App to violate laws, infringe rights, attack networks, distribute malware, bypass lawful restrictions in a prohibited manner, or engage in fraudulent, harmful, or abusive activity.
5. Subscriptions and Paid Features
Certain features, including premium VPN nodes and extended protection features, may require payment or an auto-renewable subscription. Subscription options, billing periods, prices, and renewal terms are displayed in the App before purchase.
Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account may be charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings. Refund requests are handled by Apple according to Apple's policies.
Free VPN nodes may be available without a subscription. Premium VPN nodes require an active subscription unless otherwise stated in the App.
6. Remote Configuration and Service Operation
The App may use remote configuration for operational settings and user experience tuning, such as startup timing values, version update messaging, default subscription plan selection, VPN connection timeout, retry values, and default VPN node selection behavior.
Remote configuration is not used to detect App Review, hide features, unlock undisclosed functionality, or change the App's core behavior for different users. Visible App features are described in the App and App Store metadata.
7. Updates and Changes
We may update, modify, suspend, or discontinue any part of the App at any time. Updates may be required for security, compatibility, legal, or operational reasons.
8. Intellectual Property
The App, website, branding, interface, software, and related materials are owned by VSEEK or its licensors and are protected by intellectual property laws. You may not copy, modify, reverse engineer, or distribute the App except as permitted by law.
9. Third-Party Content and Services
The App may allow access to third-party websites, services, or content. We are not responsible for third-party materials, policies, or practices, and your use of them may be governed by separate terms.
The App may also rely on third-party infrastructure, analytics, diagnostics, payment, attribution, crash reporting, and VPN server providers. Your use of third-party services may be subject to their own terms and privacy policies.
10. Disclaimer
The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, VSEEK will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or service availability.
12. Termination
We may suspend or terminate your access to the App if you violate these Terms, create risk for us or others, or if required for legal, security, or operational reasons.
13. Governing Law
These Terms will be governed by applicable laws, without regard to conflict of law principles, unless local consumer protection laws require otherwise.
